What is a Grounds of Appeal?
A Grounds of Appeal document sets out the basis of your challenge to decisions made by your Local Authority regarding your child's Education, Health and Care Plan (EHCP). It identifies the specific aspects you are appealing and provides the legal framework for your case.

What is a Draft EHCP Check?
A Draft EHCP Check is a comprehensive review of your child's draft Education, Health and Care Plan before you submit your comments to the Local Authority. This service helps ensure the plan accurately reflects your child's needs and contains legally enforceable provisions before it becomes final.
Our Draft EHCP Check Service
We will thoroughly review your draft EHCP and the supporting professional reports to ensure the plan is legally compliant and properly captures your child's needs and required provisions.
Our expert review will:
Verify EHCP compliance with paragraph 9.69 of the SEND Code of Practice (2015), focusing on legal enforceability with clear amendments where these requirements are not met
Ensure all four 'Areas of Need' are appropriately addressed throughout the Education, Health and Care Plan
Check that all needs identified in professional reports are accurately recorded in the correct sections of the plan
Confirm that all provisions recommended in professional reports are properly specified and quantified in the appropriate sections.
Evaluate whether outcomes are truly SMART (Specific, Measurable, Achievable, Realistic, and Time-Bound), providing commentary for the Local Authority where improvements are needed.
Our service includes reviewing four standard reports.
We work to your deadline, typically completing the check at least 24 hours before your submission date to allow time for your review.
Service Limitations
Please note:
The Local Authority must allow you at least 15 days to comment on the draft EHCP under Regulation 13(1) of the SEND Regulations (2014)
While we provide expert recommendations, 'SEND Help - You' cannot guarantee that the Local Authority will accept all suggested amendments.

Working Document
The Working Document [WD] is an important aspect of your appeal.
The WD is a Word version of the Education, Health and Care Plan.
The WD will be sent back and forth between parties. with amendments made using the tribunal key. There is an expectation that both parties will work together to reduce the areas in dispute leading up to the hearing.
We will ensure that:
All identified needs are recorded in the correct sections, with amendments made using the tribunal key and comments advising the local authority of our reasoning. We can only include needs identified in professional advice.
Ensure that all four ‘Areas of Need’ have been used appropriately throughout the Education, Health and Care Plan WD.
Ensure that all identified provisions are recorded in the correct section, make amendments using the tribunal key where the plan fails to specify and quantify, and add comments advising the local authority of our reasoning. We can only include provisions that are identified in professional advice.
The package includes up to 4 reports as standard.
Additional work on further WD versions will be charged per hour.
