Education Health Care Plan [EHCP] Draft Check

When you book a draft check, four reports are included as standard: Educational Psychology, Speech and Language, School and Occupational Therapy. (Additional reports are charged at £30.)

The local authority must allow parents at least 15 days from the day it receives the draft to comment on it 13- (1) SEND Regs (2014). You can request longer if needed. You can also request to meet with the LA to discuss your amendments.

We will work to your deadline, completing the check (usually no later than 24 hours before)

We will;

  • Check that the EHCP is compliant with 9.69 SEND Code of Practice (2015) and legally enforceable, amending or commenting when this is not the case.

  • Ensure that all four ‘Areas of Need’ have been used appropriately throughout the Education, Health and Care Plan.

  • Amend to ensure that all identified needs are recorded in the correct sections. Only needs identified in professional advice can be added.

  • Ensure that all identified provisions are recorded in the correct section, making amendments where the plan fails to specify and quantify. Only provisions identified in professional advice can be added.

  • Check that outcomes are ‘SMART’ (Specific, Measurable, Achievable, Realistic, and Time-Bound). If not, commentary will be provided to the local authority, prompting them to amend.
